HomeMy WebLinkAbout7302-7303 (Res.)1 �(i64 • • RESOLUTION NO. 7302 RESOLUTION APPROVING AND AUTHORIZING THE EXECUTION OF A DECLARATION OF RESTRICTIVE COVENANT PERTAINING TO OUTLOT F, STILLWATER INDUSTRIAL PARK AND CERTIFYING THAT INTERIOR DRAINAGE EASEMENTS FOR LOTS 1 THROUGH 7 BLOCK 1, MATT HOOLEY ADDITION TO THE CITY OF STILLWATER ARE NOT NECESSARY. WHEREAS, on April 17, 1979, Charles M. Hooley, et al, the then record owners of Outlet F of the Stillwater Industrial Park, conveyed to the City of Stillwater by Quit Claim Deed, said Outlot F for stone water ponding ?urposes, said Quit Claim Deed being recorded April 17, 1979 as Document No. 388904, and WHEREAS, Super Valu Stores, Inc. intends to purchase from Charles M. Hooley, et al, property being adjacent to said Outlot F, and WHEREAS, Super Valu Stores, Inc. has requested that the City of Stillwater execute a Declaration of Restrictive Covenant declaring that for a period of thirty (30) years no building or other above -ground structure exceeding 31/2 feet in height would be constructed on said Outlot F, and WHEREAS, on April 2, 1980, Charles M. Hooley, et al, executed a Declaration of Covenants and Restrictions, said Declaration being recorded April 21, 1980 as Document No. 403922, and said Declaration providing that the said Charles M. Hooley et al, agreed to convey to the City of Stillwater, if required, drainage easements 5 feet in width along all of the interior lot lines of Lot 1 through 13 of Block 1, Matt Hooley Addition to the City of Stillwater, and WHEREAS, Super Valu Stores, Inc. proposes to construct a Cub Food Store on said Lots 1 through 7, Matt Hooley Addition to the City of Stillwater, and WHERE/3, the consulting engineer for the City of Stillwater had advised the Stillwater City Council that interior lot line drainage easements are not necessary for Lots 1 through 7, Block 1 of the Stillwater Industrial Park, but that drainage easements are necessary between Lots 7 and 8 and Lots 7 and 13, Block 1 of the Stillwater Industrial Park. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, as follows, to -wit: 1. That the Mayor and City Clerk may be and hereby are authorized to execute the Declaration of Restrictive Covenant pertaining to Outlot F, Stillwater Industrial Park, which Declaration shall provide that for a period of thirty (30) years no building or other above -ground structure exceeding 31s feet will be constructed on Outlot F, said Declaration of Restrictive Covenant being attached hereto and made a part hereof. 2. That the City Council of the City of Stillwater hereby certifies that interior lot line drainage easements are not necessary for Lot 1 through 7, Block 1, Matt Hooley Addition to the City of Stillwater, and that the requirement of the conveyance of drainage easements along the interior lot lines of Lots 1 through 7, Matt Hooley Addition, as set forth in the Declaration of Covenants and Restrictions dated April 2, 1980, recorded as Document No. 403922 on April 21, 1980, is hereby waived. Adopted by the City Council this 17th day of April, 1984. Attest: RESOLUTION NO. 7303 BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, that OFFICER LARRY J. DUAFFENBACH is hereby commended for his alertness, composure and professional conduct in administering life-saving treatment to Kelly McKean on January 17, 1984. OFFICER DAUFFENBACH is further commended for his actions on several other occasions involving life-saving measures. Adopted by the City Council this 17th day of April, 1984.
