Minutes of meeting held Dec. 29,read and enproved; Oath of office of ;Marren L. Meunsell as Special ;.Municipal Judge filed. On motion of Councilman Moritz Soft :Drink licenses were: granted to R. A. Hoehae,Stillwater Drag Co., George Witti,Anton Schuelling,L. W. Cayou Jr., Fred Weies, John T. Call;,han,JohnnThompson,Hen F. zoller,Clayton Meeds,and Stillwater Ledge'No. 179 5. P. 0. E. Communication from the League and Minnes.ta Municipalities giving notice of a meeting to be held at the Lowry -Hotel in St. Paul on Jan.l5th. Communication from the Stillwater Park Commission relative to the Lowell Trust Fund was reed and ordered filed. On motion of 'Councilman Moritz the application of Ben. F. zoller for a license to Bell non -intoxicating Walt Liquors at No. 307 No. Third Street was rejected. On motion of Councilman Simonet the City Clerk was instructed to advertise for bidefor the :official printing of the City for the ensuing year, bids to be returnable February 2,1937 • 7;30 P.L. The City: Attorney reported that in his opinion the claim of Alfred Scully for damage to his car was not a legal charge against the City.: The City l Attorney.. reported,that in hie opinion the City was net liable .for the oaks of R. G. Reiter for damage to his oar. On motion of Councilman Simonet an "Ordinance for Licensing and Regulating the Operation of Taxi Cabe' was placed on its second reading and read and adopted 'section by .section when the chair put the question dshall this Ordinane Pases and upon rollcall it was duly passed and adopted. On motion of Councilman Moritz the salary of the Municipal :Judge was Sized at $1000.00 per year,beginning January 1,1937. Resolution fixing thesalary of the Municipal Judge and resolution directing the payment of bills were buth duly adopted,upon roll call. On motion of Councilman Simonet meeting adjourned. Feb. 2,1937 Regular Meeting; Meeting called to order by President Merrill; All membere of the Council present. Minutes of meeting held January 5th,read and approved. Communication from the Stillwater Association suggesting the names of Oscar E. elson,E. 0. Conrad,A. W. Eleinsehnitz,V. Willie Bloom and J. E. Slaughter as a Zoning Board, and on motion of ,:Councilman Linner the above named (persons were appointed as the Zoning Board. communicationfrom State Income Tax Department of the Minnesota Tax Commission regarding making returns on salaries earned during the year 1936 was read and referred to the City Attorney. On motion of Councilman Linner Soft Drink license were granted to Carlson & O1son,Ernest Marlow,Hope R. Stewart,Morres Crotto,Andy Sjoholm, three to George Robertson,and one to John Lustig. Oaths of office of Andrew J, Holm and H C. Robertson as School Directors,and la. P. Nolan as lMunicipal J udge and D. J. MOCuish asa member of the Stillwater ParkCommission and the bond of H. C. Robertson as Treasurer of Stillwater City School District ware all presented and ordered filed. Bide from The Stillwater Post -Messenger and the Stillwater Daily Gazette for the City printing for the ensuing year were read,and on motion of Councilmen Simonet the contrast was awarded to the Stillwater Daily Gazette and said paper was designated as the official paper of the City Annual reports of the Trustees of the Firemen' Relief Association , Board of Water ' Commissioners, Carnegie Public Library and the Chief of the Fire Department were read and on motion of Councilman Linner the same were accepted and: ordered filed. Communication addressed to the Mayor from the Interim Tax Committee enclosing their report wee .presented and ordered filed. This ibeing the meeting set for thehearing on the assessment roll for Local Improvement No. 35 the matter was taken up and there being no one present to oppose the same,Gounee�l1lman Linner moved that the assessment roll as prepared by the `:City Enginelleilfre same was duly confirmed and established. City attorney reported he had taken up the matter with our representaives in the State Legislature with reference to the State taking care of the unpaid bonds on the Public Terminal end Wharf Bonds and the representatives agreed to do what they could in the matter. Also repotted he had taken up the matter of establishing a Junior College here wtah the representatives end the agreed to do all they could to promote thematter. Resolution designating City Depositories was read and upon roll call the same was duly adopted. On motion of Councilman Linner the assessments vs Lakeview Memorial Hospital covering Lots 10-11 & 12 Block 2$-Lots 4,5 & 6 Block 23 rr amounting to $112.80 was ordered cancelled on condition that said Hospital cancel the claim it has against the City. On motion of Councilman Taylor, the offices of City Attorney,City Engineer and City Clerk were declared vacant. Councilman Simonet nominated Ralph W. McGrath for the office of City Attorney,and there being but one nominee,Councilman Linner.moved that the City Clerk oast the unanimous ballot of .the. Council for Ralpl,W. koarath as City Attorney. The City '.Clerk oast the ballot and he was. declared (elected." Councilman Simonet nominated J. A. D. Abercrombie as City. Engineer and there being but one nominee Councilmen Taylor moved that the City.. Clerk cast the unanimous ballot for the..Council:for::J =A. D. Abercrombie as City Fnglneer.The City Clerk oast the ballot and he was declared duly elected. Councilman Linner nominated Chas. A. Lammers for City Clerk and Councilman Moritz nominated John McMillin for the same office. The chair appointed Councilmen Linner and Taylor as tellers. +First informal ballot gave -Lammers 2 and McGillan 2 Second informal ballot gaveLammers 2 and McGillan 3; Councilman Linner moved that the Council now take a formal ballot whims was taken resulting as follows; Chas. A. Lammers received two votes and John HeGillan received three votes and the chair declared John McGillan elected as City Clerk. On motion of Councilman Simonet,Chae. A. Lanmers/to retain the position as City Clerk until April lst. and the new City Clerk to take office at that time. Councilman Moritz nominated Mrs. Julius Rasmussen for City Treasurer, Councilman Linner nominated Margaret Nordstrom and Councilman Taylor nominated Florence Hall for the same office; Councilman Simonet moved the nominations be closed,which motion was duly seconded voted upon and carried. Hallett being taken resulted as follows; Mrs. Julius Rasmussen received 1 vote;Florence Hall 1 vote and Margaret Nordstrom received three vctee and on motion of Councilman Linner the informal ballott was declarvd formal and Margaret Nordstrom was declared duly elected as City Treasurer. Meeting having been called to approve the bond of the Oity Treasurer and to pass a resolution providing for the payment of special assessments in five installments for Local Improvement No. 35. n On motion of Councilman Linner the bond of Margaret B, Nordstrom ras approved. Resolution providing for the payment of special assessments for Local Improvement No. 35 was read and upon roll call it was duly adopted. On motion of Councilman Linner meeting adjourned. All members of the Council present,except Mayor'Merrill. Minutes of meetings held February and and Bth dead and approved. Oaths of office of Ernest Stoll as Policeman,Mergaret B. Nordstrom, es City Treasurer and Ralph W. McGrath as City Attorney were presented and ordered filed. On motion of Councilman Moritz a Soft prink License was granted to Bessie Mitchell at No. 414 So. Third Street. On motion of Councilman Simonet the Cosmopolitan State Bank was given permission to substitute six $1000.00 U. S. Sevings Bonds inlieu of securities now held by the City of Stillwater as collateral for deposits mode by the City in said bank. Reports of the City Clerk and City Treasurer for the months of DEC. 1936 and January 1937 were read and ordered filed. Report of the Chief of the Fire Department of fires attended in the rural districts since August 13,1936 was read and ordered filed. On motion of Councilman Simonet the City Attorney was instructed to prepare contracts nand have them signed by the officers of the vertous rural districts covering fire protection by the City,the price to be enraged to be $25.00 for eaob fire plus $1.00 per mile travled to and fro from the fire and if contracts are not signed within thirty days the fire protection by:the City would be discontinued in suob rural distri:it that did not sign the contract. The City Building Inspector and City Engineer presented and read hiseenuel reports, which were ordered filed. The City Engineer presented plans and specifications for the extension of the sewer in South Sherburne street and in South Holcombe and read a resolution covering said matter which was upon roll call duly adopted. The City ,Engineer also presented plane and specifications for sprinkling and treating certain streets embraced within Sprinkling Districts Noe. 14 and 16 and read a resolution covering said natter which was upon roll call duly adopted. City Engineer also presented and read a resolution determining to proceed with sprinkling and treating streets end dividing the City into Sprink- ling Districts Nos. 14 and 16 and and upon roll call it was duly adopted. On motion of Councilman Moritz the City Clerk was instructed to ask for bins for pr n ngg 500 or 1000 copies of the annual report. The F�`"construction Co.,asked for the privilege to purchase 300 square yards of rock from the City and the matter was left to the City Engineer. • Resolution directing the payment of bills was duly adopted. April, 6th, 1937. Regular Meeting; Meeting called to order by President Merrill. All members of the Council. present. Minutes of the meeting held March,2nd, read and approved, Applications of G. 1. Kelm, John Thompson, Jack W. Jewell and Clayton Needs to sell non -intoxicating Malt Liquors both On and Off premises, were on motion of Councilman Taylor granted. Applications of Margaret Carlson and Fred Weiss to sell non - intoxicating Malt Liquors both On and Off premises and application of E.A.Magnuson to sell the same, Off premises, were read and laid over until the next meeting. On motion of Councilman Moritz, a license to operate a Pop Corn wagon on the streets, was granted to George Goutsos. A letter from the Stillwater Municipal Band to Councilman Taylor in regard to some new uniforms, was read, and on motion of Councilman Moritz, the Council approved the purchase of five new uniforms, at a total cost of °165.37 and the City Clerk was authorized to pay the bill when purchase is made. A letter from Robert G. Kinsey, of IPo. 610 Wesley Temple Building, Minneapolis, Minn. in regard to auditing of city accounts was read and ordered filed. The City Treasurer's report for the Month of February was read and on motion of 6nncilman Linner, was accepted. Bids for printing the pamphlets for the 1936 Annual Report were received from the Post -Messenger and the Gazette, and on motion of Councilman Linner the City Clerk was instructed to send a written request for new bids on both 500 and 1000 oopies to be delivered to the City Clerk. On motion of Councilman Moritz the Oath of Office and the Bond for John P. MCGillin as City Clerk, were approved. On motion of Councilman Linner, the Contract and Bond of Easton- Masterman Co. for the Official Printing for 1937, were approved. Resolution authorizing the borrowing of money in anticipation of the collection of taxes, was read and upon roll call, was duly adopted. Resolution regarding, sprinkling, surfacing, treating etc. of Sprinkling Districts #14 and #16 was read and upon roll call was duly adopted and City Clerk was instructed to advertise for bids. Thomas W. Curtis Jr. made a request for permission to move the Niederer scales from Water St. and Commercial Ave. to his place of business on South Water St, but no action was taken. The chief of Pollee was instructed to keep watch that no motor driven vehicle travel at a greater speed than 30 miles per hour on the City Streets, effective April, 15th. On motion of Councilman Simonet, it was agreed to defer action on the Sherburne Street sewer. The Annual Report for 1936 was presented, and on motion of Council- man Linner was accepted and filed. J.O.Cederberg's report of audit for the year 1936 was presented and on motion of Councilman Taylor was accepted and filed. On motion of Councilman Moritz, a new typewriter was purchased for the City Clerk's office. On motion of Councilman Taylor it was agreed to employ J.A.Ramscher to audit the City Clerk's books for the period from January, 1st, 1937 to March, 31st, 1937, inclusive. Regular Meeting; Meeting called to order by President Merrill. All members of the Council present. Minutes of the meeting held April, 6th, read and approved. Application of Aulger Bros. to hold their tent show for seven days, starting August, 9th, 1937, at the same place as formerly, was on motion of Councilman Linner, approved, with the understanding that they pay the license fee of 350.00 for same. A letter from tir. & Mrs. William Runk, of 315 St. Croix Ave. in regard to fixing St. Croix Ave. between Martha and North Fourt Streets, was read, and on motion of Councilman Taylor, was referred to the City Engineer to make a report at the next regular meeting. A letter from Mrs. Ida Clayton, of 1420 North Fourth Street, in regard to a light at the corner of Moor and North Fourth Street, was laid over. +'Fro letters from Thomas W. Curtis Jr. in regard to moving the Niederer scales, were read, and on motion of Councilman Taylor, the proposition was rejected. A letter from the Fire Department signed by all the regular firemen, including Chief McGann, in regard to raising wages etc. was read, Councilmen Taylor moved that all reguar members of the Fire and Police Departments be raised in salary $15.00 per month, each, but there was no second to this motion. Councilman Moritz made a motion, seconded by Coucilman Linner, to increase the salaries of all regular members of the Fire Department and the Police Department, v10.00 per month, effective May, 1st, 1937,which was duly passed, and a Resolution was drawn up by the City Attorney, to cover same, which Resolution was, on Roll Call, duly adopted, and the City Clerk was authorized to draw warrants on the City Treasurer, for the respective amounts. On the second reading, the applications of Fred Weiss and Margaret Carlson to sell Non -Intoxicating Malt Liquors, On and Off premises, were, on motion of Councilman Moritz, granted. A letter from the League of Minnesota Municipalities was read, and on motion of Councilman Taylor, was placed on file. The application of E.A.Magnuson, on second reading, to sell Non intoxicating Malt Liquors,"Of£" Premises only, was on motion of Councilman Moritz, rejected, unless he applies for Premises, Sale" also. 0n motion of Councilman Taylor the following licenses to sell Non -Intoxicating Malt Liquors were granted. For both "On" and "Off" sale to Ernest Marlow, Arthur Dahlquist, John H. Klatt, Morris Crotto and Andy Sjoholm, and for "ON Sale" to Oscar Ostrom, John M. Ertle and the Elk's Lodge. On motion of Councilman Taylor, a Soft Drink License and a Billiard Table license, were granted to R. F. Kaiser. Applications to sell Non -Intoxicating Malt Liquors, from Raymond A. Marlow, for "ON"and "Off" sale, and from Leo Kennedy, Charles E. Johnson, Ray Hoehne and Percy Sherrard to sell the same, "Off Sale" and from Percy Sherrard for a Soft Drink Lieense, were received, and on account of being in the residential district, were laid over until the next regular meeting on June, 1st, 1937. Bids for furnishing and applying tar on Sprinkling District No. 16 from Kopper's Company of St. Paul and The Barrett Company of Minneapolis, were read, and on motion of Councilman Taylor, the bid of the hopper's Company,being the lowest bid, was accepted, and the hid of Patrick Hurley, for sprinkling with water, Sprinkling District Mo. 14, being the only bid, was on motion of Councilman Moritz, accepted, and the proper officers of the City were instructed to enter into contracts with both the Kopper's Company and with Patrick Hurley, covering the matter of their respective bids. The bid of Easton- Masterman Co. for printing either 500 or 1000 copies of the 1936 Annual Report, being the only bid, was, on motion of Councilman Lipner, accepted, with the understanding that it be for 500 copies. On motion of Councilman Linner, permission was granted to the American Legion to sell fireworks for three days only, July, 2,3 and 4-1937 J. Hamacher read parts of his report of audit of the City Clerk's books for the three months period ending March, 31st, 1937, and on motion of Councilman Linner the City Clerk was instructed to take up with Charles A. Laanners, the matter of a few small errors, dur'_ng the period of the audit. The matter of overlooking the cost of the Police Department, for 1936, which cost was $;11217.00, in making up the figures for the 1937 budget, was brought to the attention of the Council, but no action was taken. The report of the City Treasurer for the month of March, and the reports of the City Clerk for the month of Larch and for the month of April, were presented, and on motion of Councilman taylor, were accepted and filed. The matter of fire servir= for the 'aural cormunities adjacent to Stillwater, were discussed, and left to the City Attorney to "iron out". • • • • . 74 5-i-1937 J.F.D.Abercrombie requested from the Council an increase in salary of 030.00 per month and on motion of Councilman Linner, this increase was granted, effective May, 1st, 1937, and the City Attorney was instructed to include it in the Resolution covering the increases in salary to the Fire Department and Police Department members. The City Attorney also presented a Resolution releasing the United States Fidelity and Guaranty Company of Baltimore, Maryland, on the Bond of Charles A. Lammers, for any act of his subsequent to March, 31st, 1937, which Resolution was, on Roll Call duly adopted. The City Attorney also presented a Resolution approving Securities of the Cosmopolitan State Bank pledged to the City to secure deposits, which Resolution was, on Roll Call, duly adopted. A tentative Ordinance, covering bicycles, was read by the City Attorney, which, after some discussion, wrs laid over for future consideration. Fire Chief McGann brought up the matter of purchasing 500 feet of one and one half inch hose for the Fire Department, stating that it was badly needed. Councilman Linner moved that the City Clerk be instructed to advertise for bids for same, the motion being seconded by Councilman Moritz, but, on a vote, the motion was lost. On motion of Councilman Simonet the Chief of the Fire Department was authorized to purchase 500 feet of one and one half inch Eureka hose at a price of .85 cents per lineal foot. Fire Chief McGann notified the Council that on account of vacations about to start he would need a relief man at the Fire Department, and on motion of Councilman Moritz, it was agreed to hire William Eves'', as relief man at the Fire Department. City Engineer Abercrombie reported that Mrs. Roy, who lives on Stillwater Ave. wished to get permission to connect with the North First Street Sewer, as an outlet and that the cost of same would be Fifty Dollars, and on motion of Coun.;Slman Taylor, the City Engineer was allowed to have this done on payment by Mrs. Roy of the Fifty Dollars. The salary of Arthur Glass of the City Dump was discussed but no action was taken. It was decided to hold an Informal Meeting of the Council on Saturday, May, Sth, at 3.00 P.M. Regular Meeting; Meeting called to order by President Merrill. All members of the Council present. Minutes of the meeting held May, 4th, read and approved. A letter signed "A Taxpayer" in regard to parking of taxicabs was read and as there was no name signed to the letter it was decided to take no action on it. A letter from the League of Minnesota Municipalities was presented. and ordered placed on file. Report of the City Treasurer for the month of April was read and on motion of Councilman Moritz, was accepted and filed. Report of the City Clerk for the month of May was read and on motion of Councilman Linner, was accepted and filed. Applications of Theodore Bergren and Magnus Holmblad to pay the assessments on Local Improvement No. 35 in installments, were, on motion of Councilman Linner, granted. On the second reading of applications for 3.2 beer licenses, the following applications were granted. On motion of Councilman Simonet to Ray A. Hoehn for "0ff Sale" at No. 804 North Fourth Street. On motion of Councilman Taylor to Leo Kennedy for "0ff Sale" at No. 603 West Churchill Street. On motion of Councilman Linner to Charles E. Johnson for "0ff Sale" at No. 224 :"Test Laurel Street. On motion of Councilman Linner to Percy Sherrard at William & North Streets for "Off Sale" and for "Soft Drink". On motion of Councilman Taylor to Raymond A. Marlow for both "Off Sale" and "On Sale" at No. 517 North Owen Street. Application of Lott Motor Co. for a "Soft Drink" license at Olive and South Second Street was, on motion of Councilman Taylor, granted. Application of Everett L. Kalk for both "On Sale" and "Off Sale" of 3.2 beer at No. 232 South Main Street, was, on motion of Councilman Lipner, granted. Application of Ray A. Thompson for an "0ff Sale" license cn 3.2 beer at North Fourth & Wilkin Streets, on account of being in the residential district, was laid over to the next regular meeting to be held on July, 6th, 1937. R. W. McGarry made a short talk on the Workmen Compensation Insurance on City employees, which his 6ompany carries, and which policy expires July, 1st, 1937 and he cited figures as to refunds etc. and on motion of Councilman Moritz it was decided to insure the City employees for Workmen Compensation for the year starting July, lst, 1937 with the R. 71. McGarry & Son Agency. A check from the German Farmers Mutual Insurance Company for 1u125.00 was presented by Howard Whalen, one of their officers, which check was for runs made by the Stillwater Fire Department from September, 16th, 1936 to date to various places in the rural districts in Washington County and Mr. date, stated that his Company would agree to pay @25.00, plus the cost of any extra men, for each and every fire that the Stillwater Fire Department makes a run to, to any farm in Washington County, outside of the villages, and on motion of Councilman Taylor the City Attorney was instructed to draw up a contract with Mr. Whalen's Company covering these matters. Fire Chief McGann reported that Asst Chief Gust A. Swanson had been injured in a fall from a scaffold at his home and that he was now at Lakeview Hospital. The City Attorney presented the contract with Patrick Hurley for sprinkling, which was on motion of Councilman Simonet, approved and accepted. The City Attorney stated that he had mailed the contract for tarvia, to the Koppers Company. The City Attorney also stated that he had made an investigation about the property on Wilkin Street that the Municipal Band wished to use, ane found that it was owned by a woman in Great Falls, Montana, but that no taxes had been paid on name since 1921 and no action, was taken but it was suggested to let the Band use it. Police Chief Castle reported that vacations on the Police Force would start soon and on motion of Councilman Taylor the Mayor was authorized to appoint, subject to the approval of the Council, a relief man for the Police Department during vacation time. Councilman Linner stated that the bathing beach committee of the American Legion has had trouble getting a good life guard at the bathing beach and moved that the Council set the salary of the life guard at •i100.00 per month for the duration of the bathing season with the understanding that the life guard pay any help he may need extra„ which motion was duly passed • • • 76 • • 6-1-1937 The opening and closing time of the 3.2 beer places was discussed but no action was taken and it was decided to leave that matter to the Chief of Police for the present. Effective June, 7.st, 1937 the following salaries were set. On motion of Councilman Simonet seconded by Councilmen Taylor the salary of the caretaker at the City Dump was set at $60.00 per month. On motion of Councilman Linner, seconded by Councilman Moritz, the salary of the City Clerk was set at $150.00 per month. On motion of Councilman Taylor seconded by Councilman Simonet, the salary of the City Attorney was set at U125.00 per month. On motion of Councilman Taylor, seconded by Councilman Moritz, the salary of the City Treasurer was set at $81.67 per month. 0n motion of Councilman Simonet, seconded by Councilman Moritz, the salary of the Judge of the Municipal Court was set et $100.00 per month. The City Attorney stated that he had prepared an ordinance regarding traffic regulations and on motion of Councilman Simonet the City Attorney read same and, on Roll Call, the first reading of this ordinance was duly approved. The City Attorney stated that the Village of Lake Elmo, by its officers, had signed the contract for runs to be made to that Village by the Stillwater Fire Department, and on motion of Councilman Taylor, the contract was approved. The City Attorney stated that the German Farmers Mutual Insurance Company had agreed to sign the contract for Rural Fire Service as soon as he has the contract drawn up. The City Attorney also stated that he had talked with Pr. J.G.Armson, of the Firemens Relief Trustee Fund about getting some money from that fund, on the truck but that Mr. Armson wanted some time to look up the matter. The City Engineer read a resolution to proceed with the work on the South Holcombe street sewer, which resolution was, on roll call, duly adopted. On motion of Councilman Taylor the City Engineer was instructed to install two catch basins on South Rolcombe street about 150 feet south of Millard street. Otis Maes spoke for a postponement on the hearing on the Sherburne street sewer extension and on motion of Councilman „4oritz, it was decided to postpone this hearing to the next regular meeting on August, 3rd, 1937. 0n motion of Councilman Taylor it was agreed to give the playground equipment now stored in the Fire barn to the Greeley School Parent Teachers Association to be used at the Greeley School during school terms with the understanding that they move the equipment and install it. The City Engineer was instructed to have the hedge near the corner of Olive and Owen streets, trimmed to comply with the City Ordinance covering same. The City Engineer read a resolution to proceed with the work of improving Orleans street between Fourth Avenue South and South Fourth Street, which resolution was, on Roll Call, duly adopted. The City Engineer stated that the tarvia work was progressing satisfactorily. Fire Chief McGann stated that he had received the 500 feet of new hose and that it was O.K. The Mayor announced the appointment of Arthur W. Kleinschnitz as a member of the Board of 'dater Commissioners to succeed himself, for the term of three years. Bids for the furnishing of materials for the Sherburne Street sewer extension from the Consolidated Lumber Co. and from the Bluff City Lumber Co. were presented and on motion of Councilman Linner,the bid of the Bluff City Lumber Co. being the lowest bid, was accepted, and the proper officers of the City were instructed to enter into a contract with them for the materials covered by the bid. A delegation of six property owners made a request that the City fix up part of Hazel street , near Hazel and Fifth streets, and on motion of Councilman Moritz, the City Engineer was instructed to take care of this as soon as possible. City Attorney McGrath read his findings and conclusions on the matter of the Astell damage claim, for the wall at the east side of their property at Clive and Third streets, and stated tact in his opinion there was no liability on Ole part of' the City and after some discussion, this matter was laid over to the next regular meeting on September, 7th, 1937. The City Attorney reported that he had investigated the claim for damages of Elmer 7d. Johnson to his automobile at a point on Lorth Second street and stated that the City was negligent in the matter, and that Elmer W. Johnson had agreed to settle for S75.00 and on motion of Councilman Linner it was decided to allow Johnson i;75.00 in full settlement of his claim. On motion of Councilman Lipner the City Engineer was instructed to fix up any of those places like where the Johnson accident occurred, so that there may be no more claims of a like nature. A communication from the Stillwater School Board, signed by A. J. Holm, Secretary, was read, requesting a levy for school purposes for next year of a72,000.00 and as this was S5,000.00 more than last year, on motion of Councilman Moritz, the City Attorney was instructed to write the School Board asking them the reasons for the increase. The matter of the watering troughs at Willard and South Fourth streets and at Hickory and North Fourth streets, was discussed but this was laid over to the September, 7th, meeting and the City Attorney was instructed to take up the matter with Reuben Jacobson. The City Engineer presented two assessment rolls covering sprinkling districts No. 14 and No. 16 for 1937. A delegation, with Wally Krueger as spokesman, requested the Council to have the City establish and maintain a skating r?nk at Lily Lake, and on mocion of Councilman Taylor this project was approved with the understanding that the Park Fund levy be increased one half mill, to take care of same. A letter from the War Department approving the plans for the boat dock to be constructed at the river front at Lowell Park, was read, and the C1:5 Clerk was instructed to acknowledge receipt of same. Some correspondence between William Mahoney, Liquor Control Commissioner and Mayor Fred B. Merrill, regarding the handling of the 3.2 beer situation was read. On motion of Councilman Moritz, licenses for "On" and "Off" sale of 3.2 beer were granted to John T. Callahan, on second reading, at No. 117 West Churchill Street and to Anton Sohuelling, at No. 304 North Main Street, on condition that they have Restaurant licenses, or secure same. The City Engineer stated that they were clearing the brush in the areas to be flooded, which work they started about two weeks ago, but had cut none of the trees yet but would make the trees into fuel wood to be sold. He also stated that the improvements at Lowell Park were getting along good; that they have fixed the diversion of the Myrtle street sewer and were starting on the Nelson street sewer; that the widening of Elm street will be completed in a few days and that they have started on two sewer projects with W.P.A. labor. The City Engineer also stated that he and Chief McGann had agreed to defer the repairs at the Fire Hall until next spring. • The City Attorney brought up the matter of the E. J. A delegation of boys from Oak Park requested the Council to flood a skating rink for them in Oak Park but as it was deemed not leasable, no action was taken. Ray Zoller spoke about getting the City to flood a skating rink, 40 feet '7 60 feet on North Broadway and this matter was referred to the City Engineer to take it up with the Water Board. On motion of Councilman Linner, permission was granted to Emanuel S. Swanson to pay his first assessment on Sprinkling District No. 16 on or before January, 1st, 1938 as the ownership of the property had been listed to another party and he had not received his notification in time. The City Clerk stated that the Water Board had requested the City Council co appoint an accountant to audit the books and records of the Water Board, starting January, 3rd, 1938, for the .fiscal year ending December, 31st, 1937, and on motion of Councilman Taylor, Mr. J. Hamacher was appointed to do this work and also to audit the City books and records when the time comes for that audit. W. J. Madden, H. C. Robertson and A. J.
