ADJOURNMENT i 1 I \' ater TOE DIRTNELOCE Of MINNESOTA DOWNTOWN PARKING COMMISSION MEETING November 18, 2021 Chair McAllister called the meeting to order at 8:30 a.m. Present: Chair McAllister, Commissioners Anderson, Bates, Glynn, Lepage, Rheinberger Absent: Council Liaison Junker Staff present: Community Development Director Gladhill, Zoning Administrator Tait, Parks Superintendent Grode APPROVAL OF MINUTES Possible approval of October 21, 2021 meeting minutes Motion by Commissioner Rheinberger, seconded by Commissioner , to approve the minutes of the October 21, 2021 meeting. All in favor. OPEN FORUM There were no public comments. UNFINISHED BUSINESS There was no unfinished business. NEW BUSINESS Ice Rink in Parking Lot 4 Event Permit Mr. Tait explained that Chuck Dougherty has applied for a permit for a 40' x 116' public hockey rink in Parking Lot 4 from January 1-March 20, 2022 as part of Wintertime in Stillwater. When the rink is not being used for events, it will be open to the public. The applicant will pay for rink installation, maintenance, insurance, public bathrooms and heaters. They are requesting the City waive the fees for use of Lot 4. The standard fee would be $2,251. Staff recommends that because this is a community amenity, the City give them a reduced rate. Community Development Director Gladhill informed the Commission that the application to hold the World Snow Sculpting Championship in Stillwater at the end of January will be ready for the Commission's next meeting, including a request to use the remainder of Lot 4 for that event. Though the current policy is to charge for use of lots used for private events, staff is working on a broader event policy for 2022. Chair McAllister asked what is the background on the ice rink approval process last year, as it did not come before the DTPC. The ice rink has already been promoted as part of Wintertime in Stillwater, yet the DTPC is seeing the application for the first time, which puts the Commission in a challenging position. Mr. Gladhill said he understands that the first year of Wintertime in Stillwater was born out of the COVID pandemic when the City moved quickly on measures to generate business downtown. Downtown Parking Commission Meeting November 18, 2021 Chuck Dougherty, applicant, explained that Wintertime in Stillwater started in September 2020 with the Mayor leading the charge, including having an ice rink downtown. Originally, another restaurant was going to put it in their private parking lot but when that restaurant closed due to COVID restrictions, the Water Street Inn quickly picked up the idea with the thought they would do it for three years on a trial basis. Last year the Water Street Inn paid all expenses for the rink, and no fees were charged for use of the parking lot. Commissioner Glynn pointed out that downtown parking is free in the winter so revenue is not being lost. Commissioner Anderson noted the Commission has traditionally stuck to the pricing structure and let the City Council determine the discount if any. Commissioner Rheinberger asked Mr. Dougherty if paying the $2,251 charge would be a problem. Mr. Dougherty replied the rink is already costing him $13,000-14,000 a year and it is a free amenity for the public. Alex Eder, General Manager of the Water Street Inn, added that costs include his time coordinating with all the different schools, teams, hockey clubs to use the rink plus their own maintenance personnel setting up, tearing down, and maintaining the rink. Chair McAllister asked if closing Lot 4 would eliminate any handicapped parking. Mr. Gladhill said the two handicapped stalls in Lot 4 can be designated elsewhere if Lot 4 is closed. Commissioner Rheinberger asked if Mr. Dougherty would be interested in splitting the fee. Mr. Dougherty said he feels this is an amenity for the City and being charged a fee doesn't feel right. Commissioner Lepage said because parking is generally not charged in the winter and this will generate business, it makes sense to waive the fee for use of the lot. Commissioner Anderson voiced concern that waiving the fee may set a precedent for other applications. Another consideration is the wear and tear of putting that much ice on parking lot. If the City Council wishes, the Council can waive the fee. Commissioner Lepage noted, besides costs, other considerations are what size crowds will be generated, and the impact of taking away prime parking and forcing people to park out further. Mr. Gladhill stated the World Snow Sculpting Championship is expected to bring 50-60,000 visitors spread out over a week. Staff intends to reach out to event organizers after the first of the year and study all these issues. The City wants to be more proactive but it is taking a while to catch up. Motion by Commissioner Rheinberger to waive the parking lot fee for the ice rink. Motion died for lack of a second. Commissioner Rheinberger stated the ice rink is an immediate opportunity for the City, and he does not want to hinder the project. There is always a need for exceptions to policy. Commissioner Glynn remarked, for what the Water Street wants to do, there is very little impact on the rest of the parking system compared to bigger events. He leans toward granting the request. Chair McAllister asked if there was consideration of placing this rink on the Chestnut Plaza instead. Mr. Dougherty answered Chestnut Plaza is owned by MnDOT and it must be open for emergency vehicles. Chair McAllister commented it would be interesting for the City to be able to take over the ice rink at some point so it would be truly City -run. Page 2 of 4 Downtown Parking Commission Meeting November 18, 2021 Motion by Commissioner Lepage, seconded by Commissioner Rheinberger, to recommend that the City Council waive fees this year for the ice rink for the reservation of Lot 4, in recognition of the ice rink being a community amenity. All in favor. Chair McAllister reminded staff to make sure there is enough handicapped parking. Proposed Mobile Sauna Request - Lot 4 Zoning Administrator Tait explained that the owners of St. Croix Sauna LLC have made a request to install a mobile sauna in Lot 4, from December 1, 2021 through May 16, 2022. The sauna is on a mobile hydraulic trailer that lowers to the ground. It will be available for groups to rent for 75-minute sessions from 9AM-8PM Friday -Sunday. It will be staffed at all times by an attendant. The request is to use either four parking stalls in the northeast corner of the lot (preferred by the applicant) or two parking stalls in the northwest corner of the lot. The applicants have been working with the Water Street Inn which they said supports the request in order to have this be an additional amenity nearby for their guests. The Water Street Inn's private parking lot is unable to accommodate the mobile sauna since they have just enough parking for their guests. If Lot 4 is also used for the proposed ice rink, the Fire Department stressed the importance of two access points to the rink. Placement of the sauna could potentially jeopardize one of the access points. Since this appears to be a for -profit endeavor and less of an ancillary extension to Water Street Inn, staff recommends that the sauna is not located in City property on Lot 4, but rather on private property. Mike Murry and Jeff Freitag, owners of St. Croix Sauna, stated the sauna is fully capable of being on grass. Ideally they don't want to move it every day but it could be moved if events conflict. Mr. Eder, Water Street Inn, said the Water Street Inn does not have a strong vested interest in seeing the sauna but would like to support it to help promote Wintertime in Stillwater. They also have had meetings with the Chamber of Commerce regarding all three of the uses proposed for Lot 4. Chair McAllister asked for clarification whether the City prefers to keep all of Lot 4 free of parking if the ice rink is going to be there. Parks Superintendent Grode replied even though the snow sculpting event application is not ready for review, there have been lot of moving parts with that event. They propose to use a portion of Lot 4 for a beer tent and would like to use the majority of North Lowell Park, Lot 5 and Lot 9. The application was received a month ago and staff is reviewing it. Lot 4 does not seem to be able to accommodate the sauna, ice rink, and the snow sculpting beer tent. Mr. Gladhill added that there would be no parking in Lot 4 during the snow sculpting event. At other times, the remainder of the lot may be open for parking if not encumbered by an event. It is a moving target and there is an area throughout the duration of the events that must be open as a fire lane. Commissioner Anderson asked if the sauna would fit on the Chestnut Street Plaza. Mr. Gladhill replied the Chestnut Plaza is where the light show is. He added that there is a charge for using the sauna and MnDOT prohibits use of its property for any kind of sales. Chair McAllister remarked if there is no parking allowed in the remainder of Lot 4, there is no reason not to collect the fee and allow the sauna there if people can't park there anyway, as long as there is fire access. If Lot 4 will be partially open for parking, then she would recommend the sauna request not be approved and find another place. Mr. Murry and Mr. Freitag said they could put the sauna closer to ice rink to allow for easier plowing. They are flexible on placement and open to removing it the same date the ice rink closes. Motion by Chair McAllister, seconded by Commissioner Rheinberger, to recommend approval of the use of Lot 4 for the sauna in a location that works with all City needs, only if Lot 4 is determined to be closed anyway for parking. Page 3 of 4 Downtown Parking Commission Meeting November 18, 2021 Mr. Gladhill said he understands that the Council has shied away from allowing private business to use public spaces so there will be another layer of discussion at the Council. Chair McAllister amended the motion to state that the Commission recommends approval of the use of Lot 4 for the sauna only if Lot 4 is closed, with the exact location of the sauna to be determined by Public Works staff, and with the end date to coincide with the removal of the ice rink. Due to the nature of her business, the clients often have physical handicaps, are experiencing an injury, or something similar. However, the street parking in front of her store is frequently occupied with vehicles who remain there all day (primarily downtown workers and residents), and her clientele seldomly are able to utilize the parking spot in front of the store. The on -street parking in this location is limited to three hours, however Mrs. Schubert puts forth that this is too often ignored. She thinks that a more stringent time restriction, followed up by enforcement will alleviate this issue and help her business tremendously. SPECIFIC REQUEST Consideration to change the on -street parking stall's maximum parking time limit from three hours to 30 minutes. COMMENTS & RECOMENDATION The Downtown Stillwater Parking Efficiency & Management Plan, produced by HKGi in August of 2020, identifies reducing the length of time vehicles park on the street as a goal and something that downtown businesses are generally in favor of implementing. Currently only 2% of our spaces are for 30 minutes or less (for the "One -Stop -Shop, Limited User"). Because this number is so low and the parking study recognizes the need for this percentage to increase, staff could support changing this parking limit in this spot from three hours to a lesser time frame. Broader parking trends (and some Downtown Business Feedback) are trending towards the need for more very -short-term convenience parking for quick pick up. This parking trend is being seen in larger format retail in the suburban context as well, with online order pick up increasing in popularity. That being said, the Commission is in the middle of a broader policy discussion in conjunction with the City Council. If the Commission is more comfortable, this request could be held to be included in the broader context. POSSIBLE ACTIONS The Downtown Parking Commission should discuss the potential impacts of changing the time restrictions on this parking stall and recommend approval or denial to change the parking restrictions to 30 minutes. LOCATION: Multiple Downtown intersections. Specifically, where Commercial Street and Mulberry Street intersect with Main Street and Second Street. REPORT BY: Graham Tait, City Zoning Administrator INTRODUCTION Mr. Press, a Stillwater resident, has submitted a safety concern regarding various intersections downtown. He puts forth that the on -street parking is limiting the line of sight at various intersections. He believes this creates a hazardous situation for both vehicles and pedestrians. SPECIFIC REQUEST Consideration to remove the first parking stalls at select Downtown intersections, in order to improve the line of sight (see attached). COMMENTS & RECOMENDATIONS The attached map shows the approximate line of sight from the intersection of Mulberry and Main, looking both north and south down Main Street. The map shows the line of sight with the existing parking configuration, and with one parking spot removed. The City does recognize that these intersections have an issue, however it does not seem that the removal of one spot would make a meaningful difference to one's line of sight. That being said, this could be discussed in the context of a broader Downtown Parking District Inventory and Plan, currently in discussions jointly with the Commission and City Council. For individual requests such as this, Staff believes it is best to discuss in the broader context already under way in the Commission's Work Plan. POSSIBLE ACTIONS The Downtown Parking Commission should discuss the potential safety concerns and determine if they would like to eliminate some or all of the discussed parking stalls. Good afternoon Mr. Gladhill, I'm a long time City resident and wanted to bring what I consider to be a very hazardous condition to your attention. As I travel through downtown regularly, I've noticed the parking set backs at both Commercial and Mulberry streets (at both Main and 2nd.) are extremely hazardous. A driver literally has to pull out into the street to see around any cars at all corners. The condition is very obvious and presents a blind corner because the set back is not adequate. Can the set backs be expanded an additional car length to imiprove visibility around these corners? The Engineering Department has the ability to review and install/remove any parking spots (and associated signage) outside of Downtown. However, within the Downtown District, this warrants input from the Downtown Parking Commission. SPECIFIC REQUEST Consideration to remove the two parking stalls on the southbound side of Water Street (behind Amoco Station), in order to improve public safety and traffic flow. COMMENTS & RECOMENDATIONS The City Planning Department recognizes this location on Water Street as a chokepoint, which disrupts traffic flow and creates pedestrian hazards. On this block there are cars parked all along the northbound lane, and only two parking spots in the southbound lane. When cars are parked on both sides of the street, the drivable street width gets reduced to twelve feet or less, which makes it challenging to have free -flowing two-way traffic. Removing these two spots in the southbound lane would completely eliminate this problem. City staff does recommend that the Downtown Parking Commission recommend approval for the two parking stalls along Water St to be removed. POSSIBLE ACTIONS The Downtown Parking Commission should discuss the potential safety concerns and determine if they would like to eliminate these two parking stalls. The event is proposed to take place on February 26, 2022, between 10:00 AM and 10:00 PM. The set up for this event will occur the day of the event between 6:00 AM and 8:00 AM (though some no parking signs are needed to be put up on Friday for sand delivery), and the clean-up is to take place the morning after the event between 6:00 AM and 10:00 AM. This event is expected to have a turnout of around 250 to 400 people. There will be a fence around 3 sides of the event (see site plan), to help delineate the event perimeter. There will be a police officer present on Saturday from 10:00 AM to 10:00 PM due to the consumption of alcohol on public property, however the selling of alcohol will take place only in the restaurant. ANALYSIS Lot 3 will need to be reserved for all of Saturday and Sunday to accommodate the event and the next morning clean-up. Additionally, 4 spots will be needed to be reserved in Lot 3 on Friday for sand delivery. Lot 3 has 33 spaces and they can be reserved at $1.50 per spot per day. We have already been working with staff and council members to bring these events to our beautiful parks in Stillwater and will continue the work through first quarter. This letter refers to the World Snow Sculpting Championship (WSSC). The Chamber is a local non-profit 501c(6) and recently, yet not officially announced yet, has been approved to implement a Greater Stillwater Chamber Foundation which is a 501c(3). The WSSC will be managed out of the foundation. We are excited to partner with the City of Stillwater for locals and visitors to enjoy this long weekend experience in downtown. Our contract with Winter Fun LLC is for three years if it goes well; and we decide to keep it in Stillwater, with right of first refusal after that. Lake Geneva, Wisconsin hosts the national championship, and just last year their February weekend brought in over 60,000 visitors; and the region brought in 3.1 million dollars to the economy. That weekend in Lake Geneva exceeded the previous July 4th weekend in revenue and visitors. This type of effort is in direct alignment with the city's strategic plan and would greatly benefit our businesses in first quarter. World Snow Sculpting Championship (WSSC) January 18-23, 2020 Location: North Lowell Park on both sides of the Gazebo, parking lots 4-5-9, Myrtle Street (the portion in front of the Gazebo), along with other inside venues in the city. High level park logistics: Snow making will be conducted in lot 9 January 10-17th and the snow will move to the park to build the forms (all weather dependent). To properly implement this production, additional electric will need to be added to the area around lot 9 and this effort is already underway with cooperation from Xcel Energy, public works, the Chamber and O'Neil Electric. There will be two tents set up for concessions, 10-13 Snow Forms, a small snow slide, music piped in the park and live music (weather permitting) in the Gazebo on Saturday Night for the closing ceremonies and awards; and The World's Coolest Block Party on Saturday night. The sculptors will need equipment such as scaffoldings, ladders, shovels, lights etc. (purchased by the Chamber) as well as equipment to make and move the snow. There will need to be a work trailer(s) to house the equipment when not in use, four -wheelers, snow mobiles and tents for sponsors with the amount TBD. In addition, the location of the Christmas tree may need to be modified with the location of the slide. The Chamber is also seeking a program where we may be able to get some of the funds we will be spending on the permanent electricity to lot 9 returned. For example, if other large events need to use this electric in the next five years, could the Chamber get some of those funds returned directly or indirectly? The request involves reservation of one parking stall on Water Street on weekends during the summer ANALYSIS This request has been approved on a number of occasions in years past. Other than 2020, when parking stall reservation fees were waived, the fee to reserve this space has been the standard $3/stall/day for a total of $606/year. St. Paul, MN. 55101 www.cres-inc.com 1 RESOLUTION NO. 2021 - RESOLUTION GRANTING LICENSE TO PATRICIA WOLF FOR THE OPERATION OF MULTI -PERSON CYCLE TOURS ON CITY STREETS IN 2021 AND RESCINDING RESOLUTION 2019-148 WHEREAS, Patricia Wolf has made a request to renew her license to operate BierCycle Adventures, a multiple -person tour cycle, on City roadways downtown; and WHEREAS, the City Council of the City of Stillwater approved Resolution 2019-148 on December 17, 2019 for a license to operate the tour cycle business in 2020; and WHEREAS, the business will operate in substantially the same manner in 2021. NOW THEREFORE BE IT RESOLVED that the Stillwater City Council hereby grants license to Patricia Wolf to operate multi -person cycle tours on City roadways subject to the following conditions: 1. Upon review and approval of the license request by the Police Department and the Public Works Department, the City Clerk is authorized to issue a license to Patricia Wolf for the multiple -person tour cycle business. 2. Patricia Wolf may operate one multiple -person tour cycle in Stillwater. An increase in the number of cycles will require an amendment to this Resolution of Approval. 3. A license must be applied for annually from the City Clerk. The license is valid through December 31 of the year issued. 4. No license will be issued or renewed without proof of general liability insurance in the minimum amount of $1,500,000 per occurrence. 5. Operating restrictions and conditions: a. No multiple -purpose tour cycle may be operated upon a public sidewalk. b. No multiple -purpose tour cycle may use any public street or other public property as a waiting area unless such area is a legal motor vehicle parking area. c. Public safety is paramount in the operation of any multiple -purpose tour cycle. Consequently, each multiple -purpose tour cycle must be equipped with the following: i. Front and rear turn signals ii. Head lights iii. Tail lights iv. A hydraulic disc braking system v. An emergency brake in addition to a disc braking system vi. Any other equipment required to comply with applicable federal and state laws d. All multiple -purpose tour cycles are, at all reasonable times, subject to inspection by the City of Stillwater. e. Multiple -purpose tour cycle operators must have in their possession a valid driver's license while in control of any multiple -purpose tour cycle, and shall operate the tour cycle in compliance with all applicable federal, state, and local traffic laws, and in a manner so as to assure the safety of persons and property. f. Whenever alcohol is being served on a tour, the patrons who are legally allowed to drink alcoholic beverages must wear a colored wristband. g. All multiple -purpose tour cycle operators must obey and comply with any lawful order or direction of any police officer, traffic control agent, or regulatory services inspector. h. The City reserves the right to alter or limit multi -purpose tour cycle operations to specified routes and streets if required for public safety reasons. i. If Sam Bloomer Way or Mulberry Point should be limited to pedestrian traffic only, the City reserves the right to eliminate the multi -person tour bikes access to these areas. j. The City reserves the right to require that any idle multi -purpose tour cycle be parked in a specified location while idle or waiting for customers. k. Upon receipt of any serious substantiated complaints, as determined to be serious and substantiated by the City Administrator, the license will be placed on the next available City Council agenda for review. 6. During periods of flooding, the City uses Water Street as a staging area and therefore during these times the tours will not be allowed to operate from this location. 7. The rate for the reserved on -street parking space on Water Street is $3 per day. The fee for 2021 will be $606 for the entire season. This must be paid by April 30th.
