CITY COUNCIL MEETING MINUTES
November 16, 2021
REGULAR MEETING 7:00 P.M.
Mayor Kozlowski called the meeting to order at 7:00 p.m.
Present: Mayor Kozlowski, Councilmembers Collins, Junker, Odebrecht, Polehna

PLEDGE OF ALLEGIANCE
Mayor Kozlowski led the Council and audience in the Pledge of Allegiance.
RECOGNITIONS OR PRESENTATIONS
Eagle Scout Jacob Odebrecht Proclamation
Councilmember Odebrecht explained proclamations are done for many residents who
attain Eagle Scout. He recognized Jacob's efforts and his family members in attendance.
Mayor Kozlowski read a proclamation designating November 27, 2021 as Jacob Odebrecht
Day for obtaining the rank of Eagle Scout.
Centenarian Dorothy (Schnell) Gerson Proclamation
Mayor Kozlowski read a proclamation designating November 25, 2021 as Dorothy Gerson
Day in honor of her 100th birthday.
OPEN FORUM
Louise Hansen, resident of Rivertown Commons, stated that door at the top of the parking
ramp has a handicapped button to get inside, however there is no handicapped button to
open the heavy door inside near the stairwell. There is graffiti in the ramp as well.
STAFF REPORTS
Public Works Director Sanders stated that, in response to an inquiry about a crosswalk at
the intersection of Commercial and Second Street, there is one on the north side.
Police Chief Mueller reminded residents to lock their car doors due to auto theft reports. He
praised data specialists England and Weldon. The department may be contacted to help find
resources for the homeless.
Fire Chief Glaser offered holiday fire safety reminders.
City Council Meeting November 16, 2021
City Clerk Wolf stated the public documents portal on the City website is offline for 2-3
weeks for maintenance.
City Administrator McCarty stated the administrator recruitment process is underway. The
RFP for lobbyists is ready. He will keep the Council updated on OSHA vaccine mandates for
employers with 100+ employees.

Ordinance No. 1176, an Ordinance Amending the Stillwater City Code Section 31-300
entitled Establishment of Districts by Rezoning Approximately Four Acres to RB,
Two -Family Residential, CPC Case No. 2021-54
Resolution 2021-159, Deleting Trail Segment from St Croix Riverbank Stabilization and
Riverwalk Project (Project 2016-06) and Rescinding Resolution 2021-90
Resolution 2021-160, Approving Renewals of Liquor Licenses and Tobacco Licenses for
2022
Ordinance No. 1177, an Ordinance Repealing and Replacing Chapter 28, Section 28-2(7)
of the City Code of the City of Stillwater Regarding Watering Restrictions
Ordinance No. 1178, an Interim Ordinance Prohibiting the Establishment of New Uses or
the Expansion of Existing Uses Related to Cannabis and Nonintoxicating
Cannabinoids (CBD) Sales, Testing, Manufacturing or Distribution for One Year
Councilmember Polehna asked that Resolution 2021-159, Deleting Trail Segment from St
Croix Riverbank Stabilization and Riverwalk Project (Project 2016-06) and Rescinding
Resolution 2021-90 be pulled from the Consent Agenda, to be addressed after the closed
session.
Motion by Councilmember Junker, seconded by Councilmember Polehna, to adopt the Consent
Agenda as amended. All in favor.

NEW BUSINESS
Resolution 2021-161, Loop Trail Snow Clearing Joint Powers Agreement
Public Works Director Sanders explained that St. Croix County has asked if Stillwater crews
would be interested clearing snow on the 2.3 mile Wisconsin side of the Loop Trail.
Stillwater is already responsible for the wintertime maintenance of the trail on the
Minnesota side of the river including the Lift Bridge and the St. Croix River Crossing Bridge.
Staff put together a proposal and a one-year joint powers agreement calling for a $200
payment to the City each time the trail is cleared. St. Croix County has reviewed and signed
the agreement. Staff recommends that the Council approve the Joint Powers Agreement
between St. Croix County Wisconsin and the City of Stillwater Minnesota for Loop Trail
Snow Removal.

Motion by Councilmember Collins, seconded by Councilmember Junker, to adopt Resolution
2021-161, Approving Joint Powers Agreement Between St. Croix County, Wisconsin and the
City of Stillwater, Minnesota for the Loop Trail Snow Removal. All in favor.
COUNCIL REQUEST ITEMS
There were no Council request items.
CLOSED SESSION
Motion by Councilmember Odebrecht, seconded by Councilmember Polehna, to adjourn to
closed session pursuant to Minn. Stat. §13D.05, Subd. 3(b) for attorney -client privileged
communication regarding eminent domain matter for 425 Nelson Street (Dock Cafe) at 7:27
p.m. All in favor.
The meeting convened at 7:31 p.m. in the Riverview Room by Mayor Kozlowski.
Present: Mayor Kozlowski, Councilmembers Junker, Collins and Odebrecht. Also present: City
Administrator McCarty, City Attorney Mikhail and Public Works Director Sanders.
Motion by Councilmember Collins seconded by Councilmember Junker to return to open
session. All in favor.
Motion by Councilmember Junker, seconded by Councilmember Collins to approve Resolution
2021-159, Deleting Trail Segment from St Croix Riverbank Stabilization and Riverwalk Project
(Project 2016-06) and Rescinding Resolution 2021-90. Motion passed.
Ayes: Councilmember Collins, Junker, Mayor Kozlowski
Nays: Councilmember Odebrecht, Polehna
ADJOURNMENT
Motion by Councilmember Junker seconded by Councilmember Polehna to adjourn. All in favor.
The meeting was adjourned at 8:12 p.m.
