Published: January 18, 1971 Attest: 1 �.,,et� Actin City Clerk Mayor RESOLUTION NO. 4532 BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that for his faithful service to the City as a Councilman, MYRON MELSTROM, be, and he is hereby commended; that recognition be given to the fact that for the period of years he has been in office, the said Myron Melstrom, dedicated countless hours away from the comforts and associations of his home and friends, to performance of the duties entrusted to him by the citizens of this community; and that for such selfless devotion to duty, an expression of gratitude is in order. BE IT FURTHER RESOLVED, that the City Clerk be. and she is hereby, authorized and directed to spread this resolution upon the official records of proceedings of the Council and to deliver a certified copy thereof to the said Myron Melstrom. BE IT RESOLVED, by the City council of the City of Stillwater, Minnesota, that the Mayor and Clerk are authorized and directed to pay Robert S. C. RESOLVED, by the Council of the City of Stillwater, Minnesota, that the Agreement with the Stillwater Fire Fighters Association, Local No. 1922 and the City of Stillwater, Minnesota in regard to fire fighters dated the 12th day of January, 1971 is hereby approved and that the Mayor and Acting City. Clerk are authorized and directed to sign the agreement in behalf of the City of Stillwater and to affix the sale of the City to this agreement. Adopted by the,Council this 12th day of January, 1971. M., on Monday, the 7th day of December, 1970, at which time and place all persons desiring to be heard on said im,rovements were given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Still- water, Minnesota: 1. That the aforesaid improvements be, and are hereby, ordered as proposed at an estimated cost of $798,870.00, and that final detailed plans and specifications therefor be prepared by the Banister Engineering Company. WHEREAS, it has come to the attention of the City Council that due to the location of the Senior High School on West Orleans Street in the City of Stillwater and the parking which has resulted therefrom, parking on both sides of the street in this area has obstructed the normal flow of traffic; NOW, THEREFORE, BE IT RESOLVED that the Superintendent of Public Works is hereby directed and instructed to erect "No Parking" signs on the East side of Harriet Street from its intersection with the South line of Orleans Street South to Everett Drive of the City of Stillwater, and that from and after the passage and publication of this resolution and the erection of said signs, it shall be unlawful to park in the area described. BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, that the Mayor and Acting City Clerk are hereby authorized to enter into an agreement for all the materials and labor for a concrete floor in the basement of the Municipal Building from Larry LeTourneau for the price of Two Thousand Fifty and no/100 Dollars ($2,050.00) in accordance with a quotation for the same obtained from said Larry LeTourneau dated January 25, 1971. BE IT RESOLVED by the City council of the City of Stillwater, Minnesota that whereas the city's consulting engineers, Banister Engineering Company, by Duane Elliott, on February 23, 1971, reported to this council advising it in a preliminary way that the proposed sewer and watermains are feasible and should best be made as proposed at an estimated cost of $159.121.00 that: 1. Said project be and hereby is designated as Local Improvement No. 99. 2. Said Local Improvement No. 99 is proposed to be made on these streets designated in Exhibit 1 of said engineers' report dated February 18, 1971. 3. It is proposed to assess each parcel abutting on said streets on which it is proposed to make said improvements. 4. The Council shall hold a public hearing on the proposed improvements on Tuesday, April 6, 1971 at 7:30 P. M. at the Municipal Building, 216 North Fourth Street. 5. The Acting City Clerk is hereby instructed to give notice of such hearing pursuant to the provisions of Section 429.031 M. S. A. Adopted by the City Council this 23rd day of February, 1971. WHEREAS, the plans and specifications for the Chain Link Fencing and Bituminous Surfacing for the Lily Lake Park Development prepared by the Banister Engineering company of St. Paul have been submitted and same are hereby approved: THEREFORE, BE IT RESOLVED. that the aforesaid improvements be and are thereby ordered and BE IT FURTHER RESOLVED, that the Acting City Clerk is hereby authorized and directed to advertise for bids for the Chain Link Fencing and Bituminous Surfacing, said bids to be returnable on Tuesday, March 23, 1971 at 4:30 P. M., CST, and shall further state no bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check, payable to the City, for at least ten (10) percent of the amount of the bid. This proposed legislation affects not only the business firms in our trade area, but the consumer as well because freight charges are reflected in the cost of consumer goods. Efficiency in transportation is vital to the economy of the State of Minnesota and it affects every citizen of our state. we believe that passage of this measure would help to hold the line on increased freight costs and enable Minnesota'a motor carrier industry to remain competitive with other modes of transportation and with industry in neighboring states. WHEREAS, the State of Minnesota is one of the few states in this region that does not allow use of twin trailers on any highway. This restrictive law has forced carriers utilizing the efficient twin trailers in other states where they are allowed, to rehandle the freight at the Southern and Western borders of Minnesota before entering Minnesota. In many cases, this means disconnecting one trailer at the state line and using another driver and another power unit to haul the second trailer to the carrier's Minnesota terminal. This type of operation is costly and inefficient. NOW, THEREFORE, BE IT RESOLVED: That for the best interest and benefit of our business community and the consumers of this area, the City Council of Stillwater, Minnesota, herewith endorses and supports Senate File 588 and House file 655 which, when adopted, will authorize the use of 65-foot long combination units consisting of a tractor and two semi -trailers only on highways of four or more lanes in the State of Minnesota. WHEREAS certain areas of the City of Stillwater, Washington County, Minnesota are subject to periodic flooding from the St. Croix River causing serious damages to residential and business properties within these areas, and WHEREAS relief is available in the form of flood insurance as authorized by the National Flood Insurance Act of 1968 as amended, and WHEREAS it is the intent of this Council to comply with land use management criteria regulations as required in said Act, and WHEREAS it is also the intent of this Council to recognize and duly evaluate flood hazards in all official actions relating to land use in the flood plain areas having special flood hazards, and WHEREAS the Cods Citations of any State enabling legislation and of any resulting City Ordinance that authorized this City to adopt land use and control measures are Minnesota Statutes 462 and 104, NOW THEREFORE, BE IT RESOLVED that this Council hereby assures the Federal Insurance Administration that it will take legislative action as follows: (1) Enact by December 31, 1971, and maintain in force for those areas, adequate land use and control measures with effective enforcement provisions consistent with the criteria set forth in Sub -part A of Section 1910 of the National Flood Insurance Regulations, and (2) If necessary, seek State enabling legislation conferring authority to enact land use and control measures designed to reduce the exposure of pro- perty to flood loss, and (3) Take such other official action as may be reasonably necessary to carry out the objectives of the program. Such actions will include but not be limited to: (A) Assisting the Federal Insurance Administrator, at his request, in delineating the limits of the flood plain having special flood hazard on available local maps of sufficient scale to identify the location of the building sites. (B) After flood insurance is made available, furnishing representatives of appropriate Federal or State agencies or of the National Flood Insurance Association information, as requested, concerning new or substantially improvedstructures within the area of special flood hazard. This information will include flood elevations and, if there is a basement, the distance between the first floor and the bottom of the lowest opening where water flowing on the ground will enter. (C) Cooperating with Federal, State and local agencies which undertake to study, survey, map and identify flood -prone areas as well as cooperation with neighboring jurisdfctions with respect to adjoining flood plains in order to prevent aggravation of the flooding problem. WHEREAS, the business district of the City of Stillwater, Minnesota, is located in the flood plain of the St. Croix River, and that a flood, which endangered the said business district, first occurred in 1965 and was described as a flood of one hundred year incident; WHEREAS, a similar, but somewhat less severe flood occurred in the year 1969, and WHEREAS, a similar flood was predicted for the year 1971 but failed to materialize because of unusual weather conditions, and WHEREAS, in each of these floods it has been necessary for the City of Stillwater, through Federal assistance and the United States Corp of Engineers, to construct a temporary earthen dike to protect the business district of Stillwater, Minnesota, and WHEREAS, it can be anticipated from the foregoing that considerable dam- age to the business district of the City of Stillwater. Minnesota, will occur with increasing frequency and the construction and removal of a temporary dike imposes an unreasonable inconvenience and expense on all parties concerned. WHEREAS, Northern States Power Company has announced a general rate increase for electric service of approximately eight percent (8%), and WHEREAS, this Council believes that the basis for such increase should be subjected to a detailed analysis by persons skilled in utility rate -making, to provide assurance to the City and to other consumers of electricity that the rates and charges of Forthern States Power Company are justified, and WHEREAS, this Council believes that Northern States Power Company should be willing to submit to such an examination of its rates and charges, and WHEREAS, the costs of utility rate analysis incurred in behalf of the public are customarily borne by the utility being regulated: NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, as follows: 1. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; he may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list and he may pay the remaining principal balance of the assessment to the City Treasurer. 4. BE IT RESOLVED, by the City council of the City of Stillwater, Minnesota: 1. Under and pursuant to the provisions of Minnesota Statutes, Section 162.18, this Council is authorized to issue negotiable coupon general obligation bonds of the City for the purpose of financing state - aid street improvements. The bonds herein authorized are necessary to be issued for said purpose and have been duly advertised at public sale and sold upon the terms hereinafter stated. The average annual amount of principal and interest to become due on said bonds and on all outstanding State -Aid Street Bonds does not exceed 50% of the amount of the last annual allotment preceding this issue, received by the City of Stillwater from the Construction Account in the Municipal State -Aid Street Fund of the State of Minnesota, said annual allotment having been in the amount of $78,622, as certified by the Department of Highways on January 25, 1971. The proceeds of the bonds herein authorized are hereby appropriated to be used solely for the construction and improvement of approved municipal state -aid street projects within the City. 2. There shall continue to be maintained by the City Treasurer on the official books and records of the City, the separate and special Sinking Fund for the City's Municipal State -Aid Street Bonds, the moneys in which shall be used solely for the payment of the principal of and interest on the bonds herein authorized, and on any additional general obligation State -Aid Street Bonds heretofore or hereafter issued under the authority cited in paragraph 1 hereof, and directed by the City Council to be paid from such fund. If at any time the moneys in said fund should be insuff- icient to pay all principal and interest due on bonds made payable there- from, the City Treasurer shall nevertheless pay the same from any moneys on hand in other funds of the City and available for such purpose, and the moneys so used shall be restored to the appropriate funds from the honeys next received by the City from the Construction or Maintenance Account in the Municipal State -Aid Street Fund of the State, which are not required for the payment of additional principal and interest. The City Clerk is hereby authorized and directed to file with the County Auditor of Washington County, Minnesota, a certified copy of this resolution, together with such other information as the County Auditor may require, and to obtain from said Auditor prior to the delivery of the bonds herein described a certificate that said issue has been entered upon his bond register. 8. BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, as follows: 1. The principal of and interest on the bonds shall be payable at the American National Bank and Trust Company, in St. Paul, Minnesota, and the City agrees to pay the reasonable and customary charges of the paying agent for the receipt and disbursement thereof. 2. The bonds and the appurtenant interest coupons shall be in substantially the form approved at this meeting. 3. Said bonds shall be prepared under the direction of the City Clerk and shall be executed on behalf of the City "tv the signature of the Mayor and the City Clerk, and by printing thereon a facsimile of the official seal of the City. The appurtenant interest coupons shall be executed and authenticated by the facsimile signatures of said Mayor and Clerk. When said bonds have been so executed and authenticated, they shall be delivered by the Treasurer to the purchaser thereof upon payment of the purchase price in accordance with the contract of sale heretofore made and executed, and said purchaser shall not be obligated to see to the application of the pur- chase price. 4. Ther is hereby created a separate fund of the City designated as"1971 Improvement Construction Fund", which shall be maintained until payment of all costs and expenses incurred in construction of the improve- ments with respect to which the bonds herein authorized are to be issued. In said fund there shall be maintained a separate subfund or account for each improvement financed by the bonds herein authorized. To such accounts there shall be credited from the proceeds of the bonds herein authorized amounts as follows: To the Local Improvement No. 98-1 Account $111,675 To the Local Improvement No. 98-2 Account 457,800 To the Local Improvement No. 99-1 Account 10,400 To the Local Improvement No. 99-2 Account 68,600 $648,475 and from said accounts there shall be paid all costs and expenses of said improvements, respectively. There shall also be credited to each account all special assessments and ad valorem taxes collected with respect to the improvement on account of which it was created until all costs of such • • • • improvement have been fully paid. After payment of all costs incurred with respect to such improvement, the account therefor shall be dis- continued and any bond proceeds remaining therein may be transferred to the other accounts or to a fund established for construction of any other improvement instituted pursuant to Chapter 429, Minnesota Statutes. All special assessments and taxes on hand in each account when terminated or thereafter received, and any bond proceeds not so transferred, shall be credited to the Improvement Bond Account in the Sinking Fund of the City. 5. The bonds herein authorized to be issued shall be payable from the Improvement Bond Account in the Sinking Fund of the City, which Account the City agrees to maintain until said bonds have been paid in full. If the money in said Account should at any time be insufficient to pay principal and interest due on said bonds, such amounts shall be paid from other funds of the City, and Much other funds shall be reimbursed therefor when sufficient money becomes available in said Improvement Bond Account. The honeys on hand in said Account from time to time shall be used only to pay the principal of and interest on the bonds herein authorized and such other general obligation improvement bonds issued pursuant to Minnesota Statutues, Chapter 429, as the Council shall be resolution designate. Into said account shall be paid the accrued interest and any unused discount received from the purchaser on delivery of the bonds, and the additional amount of $35,000 from the proceeds of the bonds which is estimated to be necessary to pay interest on the bonds during the construction period. 6. The City hereby covenants and agrees that, for the payment of the cost of each improvement financed by the issuance of the bonds herein authorized, it will do and perform all acts and things necessary for the final and valid levy of special assessments in a principal amount not less than 100% of the cost thereof. The assessments shall be collectible in ten consecutive annual installments, the first installment to be collectible in 1972 as to some and 1973 as to the remainder of the assess- ments, the unpaid installments to bear interest at the rate of 8% per annum. In the event that any such assessments shall at any time be held invalid with respect to any lot or tract of land, due to any error, defect or irregularity in any action or proceeding taken or to be taken by the City or by this Council or by any of the officers or employees of the City, either in the making of such assessments or in the performance of any condition precedent thereto, the City hereby covenants and agrees that it will forthwith do all such further things and take all such further proceed- ings as shall be required by law to make such assessment a valid and binding lien upon said property. 7. The full faith, credit and taxing powers of the City are hereby irrevocably pledged to the payment of the bonds and the interest thereon when due. It is hereby estimated that the collections of special assessments and interest thereon will provide sums which will amount to no less than 105% of the principal of and interest on the bonds when due. 8. The City Clerk is hereby authorized and directed to file with the County Auditor of Washington County a certified copy of this resolution and to obtain from said County Auditor a certificate stating that said bonds have been entered upon his bond register. 9. The officers of the City and said County Auditor are hereby authorized and directed to prepare and furnish to the purchaser of said bonds and to the attorneys approving the legality of the issuance thereof. certified copies of all proceedings and records relating to said bonds and to the financial affairs of the City, and such other affidavits, certificates and information as may be required to show the facts relating to the legality and marketability of said bonds as the same appear from the books and records under their custody and control or as otherwise known to them, and all such certified copies, certificates and affidavits including any heretofore furnished, shall be deemed representations of the City as to the facts recited therein. WHEREAS, pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessment for Modifications of the Lily Lake (Brick Street) Sewage Pumping Station. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota: 1. That such proposed assessment is hereby accepted and shall con- stitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of three (3) years, the first of the installments to be payable on the first Monday in January, 1972 and shall bear interest at the rate of seven (7) per cent per annum from the date of the adoption of this assessment resolution. WHEREAS, at a meeting of this Council held on the 22nd day of June, 1971, a petition was presented praying for the vacation of a portion of East School Street in the City of Stillwater hereinafter described; and WHEREAS, at said meeting the Council did, after due consideration, deem it expedient to proceed with said matter and did order the said petition to be filed in the office of the City Clerk; and WHEREAS, the City Clerk did thereupon and thereafter given notice by publica- tion in the Stillwater Evening Gazette, official newspaper of the City, for four successive weeks beginning on Thursday, July 8, 1971, and thereafter on Thursday of each week to and including July 29, 1971, to the effect that said petition had been filed as aforesaid and stating concisely its objects and that said petition would be heard and considered by the Council at the Municipal Building in the City of Stillwater, Minnesota, on the Loth day of August. 1971 at 7:30 o'clock P. WHEREAS, the communities of Stillwater and Stillwater Township have been and now are involved in two annexation proceedings in which interests important to both communities are at stake; and WHEREAS, it is vitally important for the City of Stillwater to expand its boundaries to provide for future commercial, industrial and residential growth; and WHEREAS, there are currently two proposals for the development of portions of Stillwater Township which are contingent upon annexation to the City of Stillwater: 1. Wild Pines (107 acres), Municipal Commission No. A-1985 2. Hooley-Feely (175 acres). Municipal Commission No. A-2056 WHEREAS, the development of both of the above parcels of land is deemed to be extremely important to the entire St. Croix Valley as a stimulant to existing commerce and industry, as a source of new jobs, and as a provider of housing for current and future residents of the area and the delay of which might permanently and seriously impare the proper growth and development of the City and its environs; and WHEREAS, the Stillwater City Council does appreciate the concern of the Stillwater Town Board over the problems created by annexations; and WHEREAS, the City Council of the City of Stillwater recognizes that such expansion of its boundaries can create problems for the Town of Stillwater for which said Town will require an opportunity to plan; and WHEREAS. it is recognized that sound development of the entire Stillwater Area can only come as the result of sound planning and effective plan enforcement; and WHEREAS, it is recognized and agreed to by the Stillwater City Council that the area of Stillwater Township now bounded by the Village of Oak Park Heights, T.H. No. 212, Washington County Road No. 37, T. H. No. 96, and the Stillwater City Limits is the area of the Township which is most likely to develop and to be in need of both urban services and extensive land use planning in the foreseeable future: NOW, THEREFORE, BE IT RESOLVED, by the City Council of Stillwater, Minnesota. that it hereby proposes that the two communities of Stillwater and Stillwater Township enter into orderly annexation proceedings, as authorized by Minnesota Statutes. Chapter 414.032, for that portion of the Township bounded by the Village of Oak Park Heights. T. H. No. 212, Washington County Road No. 37, T. H. No. 96. and the Stillwater City limits. Such agreement shall be accomplished by joint Resolution of the two governing bodies. BE IT FURTHER RESOLVED, that the City proposes that the joint Resolution shall contain the following conditions: 1. That the Stillwater Town Board will withdraw its objections and opposition to the above cited Wild Pines and Hooley-Feely annexation proceedings so that annexation and consequently the desired developments will take place. 2. That for a period of three years subsequent to the approval of such orderly annexation proceedings by the Minnesota Municipal Commission, no portions of Stillwater Township will be annexed to the City. 3. That during said three year period, should development of property in Stillwater Township occur which requires urban services which can best be provided by the City, the City will contract with the Township to provide such services. • • • 174 e • 4. That the parties will engage a Planner who is mutually acceptable to prepare a detailed comprehensive land use plan for the undeveloped areas of the city and of the Township south of T. H. No. 96. Said Planner shall be urged to make full use of existing plans and studies of the area and shall consult with both City and Town officials in his studies. The Washington County Advisory planning Commission shall act as the arbiter of disputes between the City Council and the Town Board over the proper land use for a portion of the planning area or over other matters which may arise in the formulation of the Plan. Upon completion, the Plan shall be adopted by the City Council and by thy. :own Board as the official plan for the area. In the formulation of the Plan, consideration shall be given to long range plans for the needs of that portion of the Township lying north of T. H. 96. 5. That the cost of the Plan shall be apportioned between the City and the Township based on the official 1970 census: City of Stillwater 10,191 91% Stillwater Township 1,014 9% 6. WHEREAS. the corporate limits of the City of Stillwater extends to the middle of the St. Croix River on the east including the islands therein; and, WHEREAS, the City of Stillwater (Pursuant to law and its Charter) exercises concurrent jurisdiction with the State of Wisconsin to the east shore of the St. Croix River on the east border of said City; and WHEREAS, the City of Stillwater by ordinance prohibits the discharge of fire- arms within its boundaries; and, WHEREAS, hunters repeatedly take migratory waterfoul on the St. Croix River within the corporate boundaries of the City of Stillwater by discharging. firearms; and, WEERERS, enforcement of the City ordinance against the discharge of firearms is difficult unless the State of Minnesota and Wisconsin through their Departments of Natural Resources also close this portion of the River to hunting; NOW, THEREFORE. AND WHEREAS, it appears that Erwin Montgomery Construction Co. of Osseo, Minnesota, is the lowest responsible bidder for the construction of said improve- ments with a bid of $113,632.00, NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF STILLWATER, MINNESOTA: 1. That said improvements be, and they are hereby, ordered as proposed. 2. That the bid of the Erwin Montgomery Construction Company be, and the same is hereby accepted; and that the Mayor and the City Clerk are hereby authorized and directed to enter into a contract with the said Erwin Montgomery Construction Company in the name of the City for the construction of said improvements for the contract price aforesaid; said contract to be in accordance with the plans and specifications which are on file in the office of the City Clerk. 3. That the City Clerk shall retain the deposits made with the three lowest bids on said improvements for thirty days from and after November 16, 1971, or until contracts are signed, whichever event first occurs. BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota, as follows: 1. It is hereby found, determined and declared that it is necessary and expedient for the City forthwith to issue its general obligation bonds in the amount of $140,000 for the purpose of constructing local improvements, including $2,740 of bonds representing interest, as authorized by Minnesota Statutes, Section 475.56. 2. The City Clerk is hereby authorized and directed to cause notice of sale of said bonds to be published in the official newspaper of the City and in the Commercial Nest, a weekly financial periodical published in Minneapolis, Minnesota.
