HomeMy WebLinkAbout6664 (Res.)• / 84 • • RESOLUTION N0. 6664 RESOLUTION DECLARING A TEMPORARY MORATORIUM ON NEW CONSTRUCTION SUBSTANTIAL IMPROVEMENTS, AND OTHER DEVELOPMENT IN AREAS OF SPECIAL FLOOD HAZARD IN THE CITY OF STILLWATER. WHEREAS, the City of Stillwater has been notified by the Federal Insurance Administration that its eligibility for participation in the National Flood Insurance Program may be suspended if satisfactory flood plain management measures are not inacted by the City of Stillwater before August 1, 1979; WHEREAS, a temporary moratorium on new construction, substantial improvement, and other development in areas of special flood hazard will suffice to extend the CITY OF STILLWATER'S eligibility in the National Flood Insurance Program through the term of the moratorium. WHEREAS, the CITY OF STILLWATER acknowledges that its eligibility for partici- pation in the National Flood Insurance Program may be suspended at the expiration of this moratorium if flood plain management measures meeting the standards of Section 1910.3(d) of the program regulations (24 CFR 1909, etc.) are not eneacted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Stillwater: Section 1 - That new construction, substantial improvement, and other development in areas of special flood hazard in the CITY OF STILLWATER identified by the Office of Federal Insurance and Hazard Mitigation in a scientific and engineer report entitled: "The Flood Insurance Study for the CITY OF STILLWATER" dated January, 1973 with accompanying flood insurance rate maps and flood boundary - floodway map shall not be permitted prior to September 15, 1979. Section 2 - That the building department shall be formally instructed by the City Coordinator that no permits for new construction, substantial improve- ment and other development shall be issued within Federal Insurance Administration designated areas of special flood hazard prior to September 15, 1979 or upon adoption of and publication of flood plain management regulations. Section 3 - That this resolution is hereby declared to be an emergency measure and shall take effect and be enforced immediately after its passage and approval. The reason for the emergency lies in the fact that this resolution is necessary for the immediate preservation of the public property, safety, welfare and health.
