HPC 2021-04 CITY OF STILLWATER HERITAGE PRESERVATION COMMISSION RESOLUTION APPROVING A HERITAGE PRESERVATION USE VARIANCE FOR A SIX-OFFICE REAL ESTATE SALES BUSINESS TO BE LOCATED AT 626 4TH STREET NORTH HPC CASE NO. 2021-24 WHEREAS, the City of Stillwater received a Heritage Preservation Use Variance (HPUV) application from William (Bill) Griffith of Larkin Hoffman, representing 626 4th LLC, prospective owner, and Tom and Sandy Lynum, property owners, to convert the existing single-family residence and bed and breakfast into a six-office real estate sales business; and WHEREAS, the Planning Commission reviewed and considered the request based on the documents shown in the application in a public hearing held June 23, 2021. At that meeting, Commission discussed the request and noted the proposal was consistent with the standards set forth for the issuance of an HPUV but that a condition of approval be the garden area is a consideration for future Design Permitting review requirements . Commissioner Steinwall made motion to recommend to the Heritage Preservation Commission approval of the request, which was seconded by Councilmember Odebrecht. All commissioners voted in favor; and WHEREAS, the Heritage Preservation Commission reviewed and considered the request based on the documents shown in the application in a public meeting held July 21, 2021. At that meeting, Commission discussed the request and noted the proposal was consistent with the standards set forth for the issuance of an HPUV. Chair Mino made motion to conditionally approve the request, which was seconded Commissioner Heimdahl. All commissioners voted in favor; and WHEREAS, the Heritage Preservation Commission approved the requested six- office real estate business at 626 4th Street North with the following conditions of approval: 1. This HPUV shall not become effective until after the City Council’s 2nd Reading, and publication, of the Heritage Preservation Use Variance ordinance. 2. Plans shall be substantially similar to those found on file with CPC Case No. 2021-37 and HPC 2021-24, except as modified by the conditions herein. 3. Design Permits shall be required for any exterior alteration in excess of $10,000 or that would substantially alter the character of the structure. This shall include, but not be limited to, exterior alterations affecting the gardens. Alterations shall be reviewed for conformance to the Secretary of the Interiors Standards and generally guided by the City’s adopted historic residential guidelines. 4. At the time of building permitting, proof of parking shall be shown for six additional off-street parking spaces. In the event the City fields numerous parking complaints, the City may require the property owner to obtain a Design Permit to install parking as per the approved proof of parking plan. 5. Solid Waste must be kept inside until trash day. 6. Adequate lighting must be provided between the structure and parking areas for safety contiguous to residential structures 7. Additional external lighting is prohibited. 8. No general external lighting of the site that may impact the surrounding residential area is allowed. 9. The property is limited to a four-square foot sign that must match the architectural features of the building. Sign lighting must be directed at the sign. Downlit lighting preferred. LED lighting intensity shall be limited to no greater than 3500K. 10. All changes to the approved plans will need to be reviewed and approved by the Community Development Director. Any major changes will need to go to the Planning Commission and Heritage Preservation Commission for review and approval.
