CITY OF STILLWATER
HERITAGE PRESERVATION COMMISSION
RESOLUTION ADOPTING WRITTEN STATEMENT OF REASONS FOR DENIAL
PURSUANT TO MINNESOTA STATUTES, § 15.99, SUBD. 2, FOR A DESIGN
PERMIT APPLICATION FOR THE PROPERTY AT 225 2ND STREET NORTH
HPC CASE NO. 2021-03
WHEREAS, the City of Stillwater received a Design Permit application from Nat
Shea of Tansk, Inc. representing, Michael Russ of Archangel Assets 4 LLC, property owner
of 225 2nd Street North, for a two-story addition to the structure in the Downtown Design
Review District; and
WHEREAS, the Heritage Preservation Commission reviewed and considered the
request based on the related documents shown in the application in a public meeting held
May 19, 2021; and
WHEREAS, at the May 19, 2021, Heritage Preservation Commission meeting, the
Commission discussed the request and noted the proposal did not fit with its surroundings
and the design, materials and color represents a jarring contrast within the 2nd Street North
streetscape. Commissioners directed the applicant to explore design alternatives.
Commissioner Finwall made motion to table the request, which was seconded by
Commission Holmes. All commissioners voted in favor; and
WHEREAS¸ at the June 16, 2021, Heritage Preservation Commission meeting, the
Commission reviewed amended plans for the building. The Commission indicated the
updated design, materials and colors failed to be in harmony with the building’s
surroundings. Commissioner Finwall made motion to deny the request, which was seconded
by Commission Holmes. All commissioners voted in favor; and
WHEREAS, the Minnesota Statutes, § 15.99, Subd. 2(c), provides that “[i]f a
multimember governing body denies a request, it must state the reasons for denial on the
record and provide the applicant in writing a statement of the reasons for the denial. If the
written statement is not adopted at the same time as the denial, it must be adopted at the next
meeting following the denial of the request but before the expiration of the time allowed for
making a decision under this section. The written statement must be consistent with the
reasons stated in the record at the time of the denial. The written statement must be provided
to the applicant upon adoption.”
NOW THEREFORE BE IT RESOLVED that the Heritage Preservation
Commission of the City of Stillwater hereby adopts the following written statement of the
reasons for denial stated on the record at the June 16, 2021, regular Heritage Preservation
Commission meeting by Commissioners voting to deny the requested Building Demolition
Permit:
1. The requested Design Permit was not consistent with all the standards for
granting a Design Permit as described in Section 31-209 of the Stillwater Zoning
Ordinance. More specifically, the Heritage Preservation Commission members
voting against the requested Design Permit stated on the record at the June 16,
2021, regular Heritage Preservation Commission meeting that the request was not
justified for the following reasons:
1) Proposed alterations do not conform to the existing primary and
secondary structure setbacks and neighborhood street rhythm.
2) The height, scale, mass and proportion of the proposed alterations,
including façade openings and roof style, are not compatible with the
site and its surroundings.
3) Proposed alterations do not have four-sided detailing and materials.
Adopted by the City Council of the City of Stillwater this 21st day of July, 2021.
